Ms.Davis with her lawyer on Thursday |
Davis, who claims that she is acting 'under God's authority,' refuses to issue marriage licenses due to her opposition to marriage equality. Bunning ordered her to comply with the Constitution, regardless, and a federal appeals court and the Supreme Court both denied her requests for a stay of Bunning's decision...
...Davis says that...she is 'a vessel God has chosen for this time and this place.'...
...It is worth noting...that the county's judge executive may issue marriage licenses' in the absence of the county clerk, or during a vacancy in the office.' So if Davis is absent from her position because she has been jailed, couples in her county will once again be able to obtain marriage licenses."
NBC's story adds the information that Ms. Davis will remain in jail until she agrees to issue licenses to all couples who request one. The other clerks in the Rowan County office will face fines or jail time too if they do not comply with his order.
eye'm thynkin': I'm not happy about her becoming a martyr for marriage equality bigots; but, if the judge felt a fine would have no effect, he didn't have much choice.
I read somewhere (and lost the link) that one possibility Rowan County officials were looking into was charging Ms. Davis with failure to to do her job (the technical, legal term sounded better), which is a misdemeanor. Admittedly a minor charge, but one that would allow the County to remove her from office and replace her with someone willing to follow the law. I like that solution a lot. No job, no martyrdom.
