Update: Kim Davis' Lawyer Says She Will Defy Release Agreement

Earlier today, I relayed the news that anti-same-sex marriage Rowan County clerk Kim Davis had been released from jail where she spent the last six days after being found in contempt of court.  Her release was approved on the condition set by U.S. District Court Judge David Bunning that she not stand in the way of her deputy clerks issuing marriage licenses to same-sex couples.

Well, it didn't take long for Ms. Davis to renege on that promise.  Kim Davis' lawyer, Harry Mihet, says his client has not changed her mind and will continue to prohibit marriage licenses from being issued to same-sex couples.  He said she also will not honor those issued in her absence.

CNN reporter Martin Savidge reported, "The problem there is that the attorney says she has not changed her mind, that Kim Davis is adamant that as long as her name appears on those marriage licenses, she objects and she will attempt to stop those licenses from being distributed. Which means if she goes back on the job as is expected, she will bring the process to a halt.  That's what her attorneys believe."

Mr. Savidge said Ms. Davis' legal team told him they did not feel her release was a victory for their side because Judge Bunning had not acquiesced to their demands that her signature be removed from Rowan County marriage licenses.

what eye thynk:  Kim Davis' announcement, through her attorney, that she does not intend to honor her release agreement should lay to rest any doubt that might linger about her being in contempt of court.  And since when do people before a judge get to issue "demands?"

If Mr. Mihet is indeed telling the whole story, the possibility of charging Ms. Davis with failure to comply with the duties of her office, a misdemeanor which I first mentioned last week, seems like the best solution for ridding the county of the services of this rogue public servant.  The charge would make it possible for Rowan County officials to remove her from office, get her out of our news cycle and allow the rest of Rowan County's clerks to continue to comply with the ruling of the U.S. Supreme Court.
